1. Customer hereby agrees to subscribe to the ePromoter software, which grants Customer month to month access upon enrollment (Initial Term). The Licensed Software is a web-based email marketing application that is made available to Customer. This Agreement and the Terms contained herein will automatically renew on a month to month basis, until completion of the Initial Term. Customer may suspend usage at any time with written notification to Staffing Robot no later than 7 days prior to the end of the current month. Once you suspend usage, your account can remain suspended for 3 months. If you want to re-activate in that time you can do so at any time. However, if your account remains suspended for more than 3 months your account will be closed and your data deleted. If you want to use ePromoter after your account has been closed you will have to create a new account.

2. Customer agrees to pay fees according to the following schedule, plus any additional items specified below in Payment Detail, plus applicable sales taxes. Customer may increase the minimum monthly sending volume in order to lower this per email rate at any time.

Up to 2,500 contacts = $30/Month
2,501 to 5,000 contacts = $50/Month
5,001 to 10,000 contacts = $75/Month
10,000 to 25,000 contacts = $150/Month
Greater than 25,000 contacts = Contact Staffing Robot for price

3. Customer agrees to be charged for a the minimum monthly plan of 2,5000 contacts, on the 1st day of every month. The minimum send rate is billed one month in advance. Any sends over and above the monthly minimum will be charged to the Customer’s credit card on the 1st day of the month, for the month in arrears. This minimum will not be applied to the first (partial) month of the Initial Term.

4. Customer agrees and acknowledges that Customer is responsible for controlling access to the Licensed Software and retains responsibility and liability for any and all usage of the Licensed Software, as well as any campaigns, content and activity.

5. Customer agrees that the access to Software is granted subject to Customer’s acceptance and ensured adherence to ePromoter’s Terms of Use. Customer acknowledges that such Terms of Use are hereby incorporated into the agreement between Staffing Robot and Customer, and accepted by Customer. Customer agrees to abide by Staffing Robot’s Anti-spam Policy. Customer acknowledges that such Anti-Spam Policy is hereby incorporated into the agreement between Staffing Robot and Customer.

6. Customer agrees and acknowledges that ePromoter reserves the right to suspend or terminate Customer’s access to the Software for non-payment, in the event of a violation of the Terms of Use and the Anti-Spam Policy.. Customer agrees that the Software is to be used for permission-based email marketing in keeping with Anti-Spam laws and regulations. Customer acknowledges that in the event of a suspension or termination, Customer will not be eligible for any refund of fees paid or due.
